The Nevada Gaming Commission is one of the oldest gambling authorities in the world. Established in 1959, the commission was created as part of the gambling control act. The act is the foundation of modern gaming regulations.
Interactive gaming forms part of the Nevada Gaming Commission since 2011. They established a framework to regulate online gambling. At the time, it only included online poker and still limited other gaming forms. In 2013, the first poker site went live in Nevada. Delaware followed a similar legal framework just a year later. This increased the liquidity of online poker available in Nevada by adding more players. In 2015, both Nevada and Delaware had the ability to share poker members.
The commission uses a rather straightforward yet effective layout in terms of regulations. IT consists of five members, one of which acts as chairman. These government-appointed members serve for a four-year term on a part-time capacity.
The commission serves for various responsibilities. The primary ones, including the reaction of board member recommendations revolving around licensing matters. The board also determines permit appeals. Therefore, the commission has become the final authority for operators. It has the ability to restrict, condition, revoke, deny and approve gambling licenses.
Finally, the governor charges the commission with the responsibility of enforcing state laws. They also need to adopt regulations to suit state laws. Not only does this apply to land-based gambling, but online as well.
The Current Online Gambling Status
As mentioned above, Nevada managed to pass a law in 2013 to legalize online poker. In 2018, after the removal of the PASPA, they amended regulation 22 to include sports betting. For the time being, the state does not regulate online gaming. Instead, they are only able to legally provide online poker and sports betting.
However, it has not limited access to third-party offshore gambling sites. Therefore, residents can still access online games. With that said, these sites are not operating under licenses from the Nevada Gaming Commission. Therefore, they cannot ensure fairness or responsibility.
Sites operating under the correct licenses to provide gambling in Nevada only offer sports betting and online poker.
Focus of the Nevada Gambling Commission
As with most of the biggest gambling regulation bodies, the Nevada Gambling Commission strives to keep online gambling fair. Of course, this does not include online casino gaming at the moment. Instead, it revolves around online poker and sports betting. Many believe the act would soon include online casinos as well.
For sites to offer either of these online gambling services within the state, they need to apply for a license. This involves the need to meet various rules and regulations. These include responsible gambling and following advertising rules. Sites also have to limit all casino-based gaming options. They also need to operate with particular sports betting or poker software. This software passed the appropriate tests for reliability and fairness.
